Trademark Policy

The Sky Nexus name, logo, and associated marks are protected under the Trade Marks Act 1995 (Cth) and may be registered or pending registration with IP Australia. This policy explains permitted and prohibited uses by third parties.

Legislative framework

Our trade mark rights are founded in Australian and international law.

  • Trade Marks Act 1995 (Cth) — registered trade mark protection in Australia (IP Australia)
  • Competition and Consumer Act 2010 (Cth), Schedule 2 (ACL) — prohibits conduct that is misleading or deceptive, including passing off (s 29 false representations)
  • Paris Convention for the Protection of Industrial Property — reciprocal protection in 175+ member states
  • TRIPS Agreement — WTO minimum trade mark standards
  • Madrid Protocol — international registration system; we may seek international protection as the business grows

The following marks are owned by Sky Nexus Proprietary Limited and are protected whether registered or not (unregistered marks protected under ACL passing off provisions).

  • Word mark: 'Sky Nexus'
  • Word mark: 'Sky Nexus Cyber Operations'
  • Device mark: the Sky Nexus star/nexus logo
  • Tagline: 'Your Trusted IT Partner For A Secure Digital Future'
  • Service marks used in connection with cybersecurity and ICT professional services

Nominative fair use — what is permitted

You may refer to Sky Nexus by name in strictly factual, non-commercial contexts without our permission.

  • Factually identifying Sky Nexus as your service provider or vendor in your own materials
  • News articles, editorial commentary, or reviews — with accurate attribution
  • Academic papers, case studies, or teaching materials — with attribution
  • Hyperlinking to our website using the text 'Sky Nexus' or our URL

Prohibited uses

The following uses of our marks are prohibited without prior written authorisation. Unauthorised use may constitute trade mark infringement (Trade Marks Act 1995) and/or misleading or deceptive conduct (ACL s 18).

  • Using our logo in any marketing material, presentation, co-branding, or product without written approval
  • Implying partnership, endorsement, sponsorship, or affiliation with Sky Nexus
  • Modifying, distorting, recolouring, or incorporating our marks into other logos or marks
  • Registering our marks or confusingly similar marks as domain names, social media handles, entity names, or apps
  • Using our marks in meta-tags, paid advertising keywords, or SEO to divert our clients
  • Disparaging or defamatory use of our marks

Partner badge programme

Approved technology partners and referral partners may use the 'Sky Nexus Partner' designation and associated badge under a separate Partner Agreement. Partner badges are subject to Brand Guidelines and revocable upon breach.

Requesting authorisation

Submit all trade mark use requests to legal@skynexus.co with a description of the proposed use, context, audience, and creative mock-up. We aim to respond within 10 business days.
