Legislative framework

Copyright in Australia is automatic upon creation of an original work; no registration is required.

  • Copyright Act 1968 (Cth) — foundational copyright legislation covering literary, artistic, musical, and cinematograph works, and computer programs
  • Copyright Amendment (Digital Agenda) Act 2000 — extends protections to online/digital communication rights
  • Copyright Amendment (Moral Rights) Act 2000 — authors' right of attribution and integrity
  • Copyright Amendment Act 2006 — fair dealing exceptions for parody, satire, and private study
  • Berne Convention (implemented via Copyright Act) — reciprocal protection in 180+ member countries
  • TRIPS Agreement — WTO minimum IP standards
  • US Digital Millennium Copyright Act (DMCA) — applicable to US-based users and hosting infrastructure

Sky Nexus Proprietary Limited is the copyright owner of all original content on this site. Duration of copyright protection is as follows.

  • Literary, dramatic, musical, and artistic works — author's life plus 70 years (Copyright Act 1968 s 33)
  • Published editions — 25 years from year of first publication (s 96)
  • Computer programs — treated as literary works; author's life plus 70 years
  • Third-party content — respective copyright owners retain their rights; attributions are displayed where required

Moral rights (Copyright Amendment (Moral Rights) Act 2000)

Individual authors of works on this site retain moral rights including the right of attribution and the right of integrity. You must not falsely attribute authorship of our content or use our content in a manner that is prejudicial to the honour or reputation of the author.

Permitted use — fair dealing

Under the Copyright Act 1968, fair dealing exceptions permit limited use without permission for the following purposes.

  • Research or study (s 40) — single copy for personal research purposes
  • Review or criticism (s 41) — with attribution of the source and author
  • Reporting news (s 42) — with attribution
  • Parody or satire (s 41A) — use must not damage our reputation
  • Beyond these exceptions, no reproduction, distribution, or derivative use is permitted without our written consent

Prohibited uses

The following activities are not permitted without prior written consent from Sky Nexus.

  • Systematic reproduction, scraping, or bulk downloading of site content
  • Republication or redistribution of content for commercial purposes
  • Creating derivative works based on our content
  • Removing copyright notices or metadata from our materials
  • Circumventing technological protection measures (TPMs) — an offence under the Copyright Act 1968 s 116AN

Copyright infringement and DMCA takedown

If you believe content on our site infringes your copyright, send a written notice to legal@skynexus.co containing:

  • Identification of the copyrighted work claimed to be infringed
  • The URL of the allegedly infringing content
  • Your contact information (name, address, email, phone)
  • A statement that you have a good faith belief the use is not authorised
  • A statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorised agent
  • Your physical or electronic signature
